Following the devastation caused by the 2023 Auckland Anniversary weekend floods and Cyclone Gabrielle, Shine Lawyers is assisting homeowners to understand their rights and pursue relevant claims or resolve their outstanding claims.

Shine Lawyers will host a free information session to equip members of the Auckland and surrounding community with the information needed to manage the insurance claims process.

Shine Lawyers’ Legal Practice Manager, Pieter Venter, who is hosting the event says “We are receiving enquiries from homeowners that are unsure if they are receiving the correct payouts.  Given our extensive experience from the Christchurch earthquakes, we know what fishhooks to look out for.”

“Some councils are reneging on certain items that were understood to be previously covered, such as demolition costs.  We are able to review and advise on the correct position and negotiate a suitable settlement with the relevant stakeholders.

“Other myths we seek to dispel is what is classified as land damage or property damage, as the answer isn’t often what you think.

We are amazed that we are seeing offers for properties that don’t have any engineering assessments yet commissioned, it is important to understand how the council or insurance company is coming up with an offer, as the starting point should be what you are covered for by your policy.

“Just because an offer sounds good, doesn’t mean that you are receiving your full entitlements.  Our advice is that you should seek legal advice before signing any full and final settlement agreements,” he said.
