Aviation – CAA regulatory relief package – What Civil Aviation NZ is doing to support Air Travel Operators and Pilots

23 Aug 2021 – As a result of the extension of New Zealand’s current Alert Level 4 restrictions we have reinstated the regulatory relief package we put in place in March 2020. We appreciate that this is a difficult and uncertain time for operators and participants and we are conscious that other issues may arise for you which are either unique to your operation or which we haven’t addressed through the measures below.

If you foresee the inability to comply with a safety regulatory requirement due to the ongoing impact of COVID-19, then please engage with us early. We will take a flexible and pragmatic approach to working with you and assisting you to find solutions to the challenges you face.

Current regulatory relief measures

If you have an organisational certificate expiring between the 23rd of August 2021 and the 28th of February 2022 (this includes certificates issued under Parts 19F, 92, 109, 115, 119, 137, 139, 140, 141, 145, 146, 147, 148, 149, 171, 172, 173, 174 and 175) the CAA will carry out a process to assess the issue of a new certificate for a period of up to 12 months from the date of expiry of your current certificate; that issue subject to the satisfactory completion of an assessment that shows that there are no significant safety concerns in doing so. This will be carried out through a desktop-based risk assessment and review of the intelligence and information held by the CAA for your organisation, and receipt of an acceptable declaration by the CEO of your organisation. There will be no charges associated with this assessment and the issuing of the new certificate.  You will need to submit a declaration form, CAA RR/01, to initiate this process. If you have an upcoming Safety Management System implementation date and have not yet been certificated you will already hold an exemption for that implementation date.  If you have not yet had an on-site SMS certification inspection then that exemption will be revised to a new implementation date in 2022.  There will be no charges associated with the amendment of your current exemption and issue of a revised SMS implementation date.
